These Terms of Service govern your use of services supplied by NeuralIndex IP Holding Company Pty Ltd ("NeuralIndex", "we", "us" or "our"). By creating an account, accepting an order or using a paid service, you agree to these terms and any order or plan terms presented to you.
Who may use the service
You must be legally able to enter into a contract and authorised to act for the organisation you represent. You must provide accurate account information and protect your access credentials.
The service
NeuralIndex provides two services for real estate agencies: Be found in ChatGPT, which helps your listings appear in ChatGPT answers, and Answer buyer questions, which answers buyers on your own website from your listings, even after hours. We also provide setup help and support. The features included in your service are those shown in your accepted plan, order or proposal. Illustrations and interactive demonstrations on our website are labelled examples and are not promises of a particular result.
Subscriptions, prices and payment
Recurring plans are billed at the price and cycle shown before purchase. Public prices are in USD and exclude applicable taxes unless expressly stated otherwise. Be found in ChatGPT and Answer buyer questions have no mandatory setup fee. Any optional add-on, usage limit, overage or custom charge must be disclosed and agreed before it is charged. We do not preselect paid extras.
Stripe may process payments. You authorise recurring charges for the selected subscription until cancellation. Failed or overdue payment may result in notice, restricted service or suspension.
Free trial
Yearly plans include a 7-day free trial. Monthly plans do not. You enter a card when you start the trial. If you do not cancel within the 7 days, your card is charged the yearly price when the trial ends. If you cancel during the trial, you are not charged and your access ends straight away.
Cancellation and refunds
You may cancel a recurring subscription through the available account or support channel. Cancellation normally takes effect at the end of the paid billing period unless an order says otherwise or law requires a different result. Refunds and statutory remedies are described in our Refund Policy, which does not limit rights that cannot lawfully be excluded.
Your data and permissions
You retain ownership of content and listing data you supply. You grant NeuralIndex a limited permission to host, copy, process, enrich and display that material only as needed to provide, secure and support the service. You represent that you have the rights and authority needed to provide it and instruct us to process it.
Listing distribution permission
NeuralIndex will not distribute your listings to an AI search or discovery provider until an authorised person gives specific permission during setup. The permission screen identifies the current provider scope, purpose and data covered before an electronic signature is accepted.
Data covered. Permission may cover public listing descriptions, price and availability, property features and location, listing photos or media links, links to the original listing, and enriched details created from that information. It does not cover private account credentials or payment card information.
Purpose and current provider. The purpose is to help buyers discover and understand available properties and return to the original listing. The current provider scope is ChatGPT by OpenAI. We will not treat a general reference to future providers as permission. Before adding another AI search or discovery provider, we will identify the updated scope and request fresh permission where the change is material.
Your authority. By completing the permission step, you confirm that you own the listing information or are authorised by the owner or agency to allow its distribution for this purpose. The typed full name and confirmation action are intended to record your identity and intention to grant permission.
Permission record. We may retain the acceptance timestamp, consent version, account identifier, typed name, business and website details, provider and data scope, stated purpose, and both confirmation responses so that the permission can be verified later.
Changing your mind. You may withdraw permission for future distribution by emailing support@neuralindex.ai. We will stop new distribution within a reasonable period, subject to records we must retain and processing already carried out by a provider under its own terms.
Acceptable use
You must not use the service unlawfully; infringe rights; upload malicious code; attempt unauthorised access; bypass usage or security controls; interfere with operation; reverse engineer protected components except where law permits; or use outputs to support deceptive, discriminatory or harmful decisions.
AI and listing outputs
AI-generated search results and explanations can be incomplete or incorrect and depend on the quality and availability of source data. They are informational tools, not legal, financial, valuation or professional advice. Customers should check answers about their listings and give buyers appropriate context.
Availability and changes
We work to provide a reliable service but do not promise uninterrupted or error-free operation unless a signed service level agreement says otherwise. Maintenance, third-party systems, source data and network conditions can affect availability. We may improve or change features while preserving material paid functionality or providing appropriate notice and remedies where required.
Third-party services
Integrations may depend on providers such as listing platforms, hosting services, Stripe or Supabase. Their separate terms may apply. NeuralIndex is not responsible for a third-party service outside our control, but this does not remove responsibility we have under applicable law.
Intellectual property
NeuralIndex and its licensors own the service, software, documentation, designs and trademarks. These terms give you a limited, non-exclusive, non-transferable right to use the service during the applicable subscription. Feedback may be used to improve the service without identifying you.
Confidentiality, privacy and security
Each party must use reasonable care to protect the other's confidential information and use it only for the relationship. Our handling of personal information is described in the Privacy Policy. You must notify us promptly of suspected unauthorised account access.
Suspension and termination
Either party may terminate as allowed by the plan, order or law. We may suspend access where reasonably necessary for security, unlawful use, material breach or overdue fees, normally after notice and an opportunity to remedy where practical. On termination, service access ends and outstanding amounts remain due.
Consumer guarantees
Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. If a non-excludable guarantee applies, our liability is limited only to the extent the law permits.
Liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable. Any agreed liability cap in an order applies subject to non-excludable law. We do not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or another liability that cannot legally be limited.
Governing law and changes
These terms are governed by applicable Australian law and, where an order identifies a state or territory, the law of that jurisdiction. We may update these terms prospectively. Material changes affecting an active paid service will be communicated as required by law.
